As part of its ongoing public education effort, the Arizona Court of Appeals, Division 2 will visit campus on Tuesday, February 25.
The court visit is hosted by the College of Law’s William H. Rehnquist Center on the Constitutional Structures of Government and will include oral arguments, open to the public. Seating is limited and available to those who have registered prior to the event. Register here.
The cases being argued are:
CASE 1: 1:30-2:20 p.m.
State of Arizona v. Christopher Wayne Cooker (2 CA-CR 2023-0168)
Summary: On appeal from his convictions and sentences for aggravated driving under the influence and aggravated assault, Christopher Cooker argues the trial court violated his constitutional rights to confrontation, to a twelve-person jury and to notice of the charges against him.
CASE 2: 2:30-3:20 p.m.
Jane Doe I & II; John Doe v. The Corporation of the President of the Church of Jesus Christ of Latter-Day Saints, et al. (2 CA-CV 2023-0293)
Summary: On appeal from the trial court’s entry of summary judgment in favor of the Church defendants, the Does argue summary judgment was inappropriate because the presence of non-clergy individuals during confidential communications was behavior inconsistent with maintaining confidentiality, constituting waiver of the clergy-penitent privilege and, thus, requiring the Church defendants to report child abuse under A.R.S. § 13-3620(A).
